Ms R.D.Raskar, the learned advocate for the petitioner has argued the matter at length. However, considering the facts of the present case, I am not inclined to interfere with the impugned order.
After seeking instructions, the learned advocate for the petitioner seeks permission to withdraw the petition with liberty to file appropriate application before the Nagpur Improvement Trust.
The petition is disposed as withdrawn with liberty to the petitioner to file appropriate application before the Nagpur Improvement Trust.
It is clarified that the points raised by the petitioner are not adjudicated and as the State Government, while deciding the appeal, has not considered the application filed by the petitioner, it is kept open for consideration by the Nagpur Improvement Trust.
