Heard.

The applicant is arrested on 16th December, 2016 in crime registered against him and his mother for the offences punishable under Sections 306, 498A and 504 read with Section 34 of the Indian Penal Code. The crime is registered on the complaint lodged by brother of the deceased that because of ill-treatment meted out to the deceased by the applicant and his mother the applicant had returned to her parental house and was living there, however, on 2nd December, 2016, the applicant and his mother came to the parental house of deceased, asked her to accompany them and demanded Rs.50,000/- and stated that if their demand is not fulfilled the applicant will not cohabit with the deceased and will give her divorce and because of this the applicant committed suicide.

The investigation is complete and charge-sheet is filed. The co-accused (mother of the applicant) is released on bail. The non-applicant has not been able to point out that the custody of the applicant is required for further investigation.

2 ba395.17 Considering the facts of the case and the nature of the accusations against the applicant, following order is passed :

The applicant having been arrested in Crime No.273/2016, registered by the non-applicant, he be released on bail on executing P.R. Bond for Rs.Fifty Thousand and on furnishing two solvent sureties in the like amount. The applicant shall attend the trial before the Sessions Court on every date unless granted exemption by the Sessions Court.
