By this application, the applicant is seeking relaxation of condition which is imposed by this Court while releasing him on bail in Criminal Application (BA) No.227/2024.

Considering the nature of the offence, this Court has directed the applicant that he shall attend the concerned Police Station on 1st Saturday of every month and the Police Station Officer shall record his presence. It was further directed that he shall not leave the jurisdiction of Nagpur City without prior permission of the District Court, Nagpur.

Learned Senior Counsel Mr. Manohar for the applicant submitted that as far as the condition No.(c) is concerned, the applicant has no objection to

(2) 6.appp.747.2024 obey the said condition. As far as the condition No.(d) is concerned, the applicant is resident of Jabalpur (Madhya Pradesh) and in addition to condition No.(c) he is ready to attend the nearest Police Station at Jabalpur on every Saturday. 4.

Learned APP strongly opposed the said application on the ground that the offence alleged against the present applicant is serious in nature. If the said conditions are cancelled then, it would be difficult for the prosecution to secure the presence of the present applicant.

After hearing the learned Senior Counsel for the applicant and learned APP for the State, perused the application as well as the earlier order passed by this Court. Considering now the investigation is already completed and charge-sheet is filed. The conditions are imposed only to secure the presence of the present applicant, therefore, condition No.(c) is modified as follows:

"That the applicant shall attend the concerned Police Station on 1st Sunday of every month and the Police Station Officer shall record his presence."

The condition No.(d) is cancelled and the following directions the applicant has to obey. "That the applicant shall attend the nearest Police Station on every Sunday excluding 1st Sunday."
