This application seeking condonation of delay of 546 days in preferring appeal against conviction was listed before the Court on 08.09.2025. On that day, by a detail order the delay was condoned, the office was directed to register the appeal. Appeal was also admitted and Records and Proceeding was called. Further on the application seeking suspension of sentence, notice was issued to the respondent, and the same was made returnable on 16.09.2025.

After signing the order and uploading of the Rgd.
Order 1009appa388.25 order dated 08.09.2025, it was realized that this Court is assigned to deal with the Criminal Appeals against acquittal and Criminal Writ Petitions pertaining to Single Judge. It seems that inadvertently the office has listed this matter before this Court and inadvertently the order came to be passed.

Since as per the roaster, the appeal challenging conviction is not assigned to this Court, the matter was directed to be listed today, and accordingly the same is listed.

The learned Counsel appearing for the applicant and the learned A.P.P. conceded to this position. They requested for recalling of the order. 5.
Since as per roaster assignment the present matter ought to have been listed before appropriate Bench, however, since the order is passed on 08.09.2025, the same is recalled and office is directed to list the matter before appropriate Bench. Needless to mention that the Criminal Application No.388/2025 is restored to its original position.
