The question is, whether well in dispute has been dug within the area of tank or outside its embankment and in private land of the applicants. The complaint and reply show that allegation is of construction of well in the area of water tank.

In this situation, as disputed questions arise, we are not inclined to intervene in extra ordinary jurisdiction. Hence, leaving all rival contentions open and with liberty to the applicants to take such other steps as are open to them in law, we dispose of the present application. No costs. JUDGE JUDGE *GS.
