There is no need to issue any formal notice to the State as the reply is already filed.
This application has been opposed by the learned A.P.P. for the State. However, considering the fact that so far as this applicant is concerned, his role appears to be confined to assisting the other accused persons in extracting some money, an offence punishable under Section 384 of the Indian Penal Code for which maximum punishment is of three years and also the fact that the applicant is in jail since 13.7.2015 and the trial yet to commence, I am of the view that now this applicant could be released on bail. Hence, the order.
The application is allowed and it is directed that the applicant be released on bail on his furnishing a P. R. Bond in the sum of Rs.25,000/- with one solvent surety in the like amount on the condition that the applicant shall attend the trial Court regularly on the date fixed in the matter, shall cooperate with the trial Court in expeditious disposal of the matter and shall not tamer with the prosecution witnesses.
