DATE : 10/08/2020 Hearing was conducted through Video Conferencing and the learned Counsel agreed that the audio and visual quality was proper.

Heard learned Advocate Shri A. S. Londhe for the applicant. He has submitted that the applicant is in jail since 25-1-2020. Learned Advocate has submitted that the investigation is complete and charge-sheet is filed. Learned Advocate has submitted that punishment provided for offence is up to 7 years.

Heard Smt. Prabhu, learned Additional Public Prosecutor. She has submitted that the victim girl is minor, aged about 15 years and therefore, the application is liable to be rejected.

From the perusal of report, it appears that the victim girl was taken by the accused in the school at about 8.00 p.m. She herself went with the accused/applicant. The applicant tried to remove her clothes. It appears that the incident came to light only because her parents saw
LDVC- BA 870.2020.odt her along with the applicant and, therefore, report came to be lodged. Looking to the allegations in the report, the applicant is entitled for bail. Hence, following order. (I) The application is allowed.
(II) The applicant be released on bail on executing PR Bond in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand only) with one solvent surety of like amount on following conditions.
(a) The applicant shall not pressurize the witnesses. (b) The applicant shall attend the trial Court on each and every date.
(c) Breach of any condition amounts to cancellation of bail.

The application is disposed of.
Criminal Application (APPP) No. of 2020 (LDVC No. 6.
In view of disposal of Criminal Application (BA) No. ------ of 2020 (LDVC No. 870/2020), this application is also disposed of.
