Our attention is invited to the order dated 8th April, 2025 delivered in Writ Petition No.5862/2024 (Friends Social Circle and others Vs. State of Maharashtra and others). It is claimed that the impugned communication dated 8th April, 2025 goes contrary to the authoritative pronouncement made in the said order.

There appears to be substance in the submissions made by the counsel for the petitioner, particularly as this Court is dealing with the conditions incorporated in the Government Resolution dated 29th April, 2024. The approval to be obtained from the State Government is already held to be contrary to the provisions of Section 41A of the Maharashtra Employees of Private Schools (Conditions of Service) Rules, 1981. As such we deem it appropriate to quash and set aside the impugned communication dated 8th April, 2025. 4.

We permit the petitioner to appear before the respondentEducation Officer on 13th May, 2025 along with a copy of the order
