The applicant-wife has filed this application under Section 24 of the Code of Civil Procedure praying that the Hindu Marriage Petition No. 176 of 2010 pending before the learned Civil Judge Senior Division, Akola be transferred to the Family Court at Amravati where the criminal case filed by the applicant under Section 12 of the Protection of Women from Domestic Violence Act, 2005 is pending. The only reason given by the applicant is that it is convenient for the applicant to attend the proceedings at Akola.
The petition under Section 13(1)(i-a) and (i-b) of the Hindu Marriage Act came to be filed by the non-applicanthusband in September, 2010 and the criminal case under Section 12 of the Protection of Women from Domestic Violence Act, 2005 is filed by the applicant in March, 2011. In view of the facts on the record, I am not inclined to consider the prayer of the applicant for transfer of the proceedings from Akola to Amravati.
