NOVEMBER 10, 2025 1) Heard learned counsel for the respective parties. 2) Pursuant to order dated 07/07/2025 Hon'ble Justice Shri D.S. Zoting (retired) was appointed as an Arbitrator to adjudicate and resolve the dispute. Subsequently former Justice Shri Zoting informed that it is not possible for him to give consent to adjudicate the proceeding. Therefore, both the parties have suggested the name of Hon'ble Shri Justice R.K. Deshpande (retired) to be appointed as an Arbitrator to adjudicate the dispute between the parties. Accordingly, vide order dated 05/08/2025, the Hon'ble Shri Justice R.K. Deshpande (retired), was appointed as an Arbitrator to adjudicate the dispute. By communication dated 16/08/2025, Hon'ble Shri Justice R.K. Deshpande (retired), submitted his consent under Section 11(8) of the Arbitration and Conciliation Act, 1996 to act as an Arbitrator.

3) In view thereof, the application is disposed of accordingly.
