Heard Shri Ali, learned counsel for the applicant and Shri Joshi, learned A.P.P. for the nonapplicant/State through Video Conferencing. 2.
The applicant is said to be arrested on 03/11/209 in connection with Crime No. 285/2019 dated 03/11/2019 registered at Police Station, Maregaon, District Yavatmal for the offence punishable under Sections 302 and 201 read with Section 34 of the Indian Penal Code.

Perused the application, affidavit-in-reply and the documents annexed.

At the outset, the present applicant is arrayed as an accused only on the basis of statement of the co-accused, from whose instance, a 'dupatta' , which is allegedly used for strangulation, came to be recovered. The co-accused in the instant case has already been released on bail by this Court vide order dated 06/08/2020 passed in LDVC-Criminal
Application (BA) No. 416/2020.

The role attributed to the present applicant is not greater than the role attributed to the co-accused, who is on bail. This Court is of the opinion that the present applicant also deserves to be released on bail on the ground of parity. Hence, I proceed to pass the following order :-
ORDER
i) The Criminal Application is allowed.
ii) The applicant be released on bail on his furnishing PR bond in the sum of Rs.25,000/- with one solvent surety in the like amount.
iii) The applicant shall not pressurize or issue threats to the witnesses.
iv) The applicant shall not tamper with the prosecution evidence.
v) The applicant to supply his residential address and mobile number to the concerned police station and shall not change the same.
vi) The applicant shall not leave the local jurisdiction without prior intimation to the concerned police station.
vii) The applicant to attend the concerned police station on every first Thursday of each month between 12.00 noon to 2.00 pm.

The Criminal Application is disposed of accordingly.
