This is an application for speaking to minutes for correction of crime number.

The applicant had filed an application under Section 482 of the Code of Criminal Procedure, 1973, challenging the First Information Report and Charge-sheet against them, which was registered at Police Station, Buldhana.

In the prayer clause, it is stated that the number of First Information Report as 266 of 2020 registered with Police Station Buldhana and consequently, charge-sheet bearing SCC No.657 of 2020.

Shri Mir Rizwan Ali, learned counsel for the applicant/appellant has moved this application with a prayer

4 APPA 1087.2021 that due to his mistake in prayer clause he has quoted wrong F.I.R. number. He submits that instead of Crime No.425 of 2020 wrongly he has typed Crime No.266 of 2020. This Court is always of the view that for fault of advocate the litigant should not suffer. In that view of the matter, we pass the following order:

ORDER

(i) The Criminal Application is allowed.

(ii) In the operative order of the judgment dated 29.04.2021, in place of "First Information Report 266 of 2020", the words be substituted as "First Information Report No.425 of 2020".

(iii) The corrected paragraph 8 of the judgment dated 29.04.2021, be freshly uploaded.
