Heard.

The applicant is arrested on 28th March, 2017 in crime registered against him for the offences punishable under Sections 376(2)(i), 109, 342 of the Indian Penal Code read with Section 4 and 17 of the Protection of Children from Sexual Offences Act, 2012 on the accusations that he has sexually exploited the victim aged about 16 years. The learned advocate for the applicant has submitted that subsequently the applicant has married with the victim. The facts on record show that the complaint is lodged after two years of the alleged crime. The applicant is in custody for almost 3 months. The non-applicant has not been able to point out that the custody of the applicant is required for further investigation.

In the facts of the case, following order is passed :

2 ba399.17 The applicant having been arrested in Crime No.46/2017, registered by the non-applicant, he be released on bail on executing P.R. Bond for Rs.Twenty Five Thousand and on furnishing one solvent suretys in the like amount. The application is allowed in the above terms. JUDGE RRaut..
