This motion is moved for initiating contempt proceedings.

Accused Ramesh Pund was extended interim protection subject to deposit of Rs.9,00,000/-. He deposited cheque for Rs.4,00,000/-, which was not honoured. This Court withdrew the interim protection and it is common ground that Ramesh Pund was arrested and later on released by the Magistrate subject to deposit of Rs.3,00,000/-.

Some explanation is given for the inability to comply with the undertaking given to this Court. While the explanation is not satisfactory, considering that Ramesh Pund has already undergone bypass surgery and that he has

appp779.20.O.odt deposited Rs.3,00,000/- as directed by the Magistrate, I do not consider if necessary to initiate contempt proceedings. 4.

The application is disposed of with liberty to the complainant to initiate appropriate action for recoveries before the appropriate forum.
