Shri S.P.Deshpande, advocate holding for Shri A.H.Lohiya, advocate for the appellant states that the appellant is in a position to furnish solvent surety of Rs.1,67,00,000/- within three days and for furnishing solvent surety for balance amount, as per the judgment dated 21st March, 2018, the appellant seeks further time of four weeks. Accepting the submission made on behalf of the appellant, following order is passed:

i) If the appellant furnishes solvent surety for Rs.1,67,00,000/- (Rs. One Crore Sixty Seven Lakhs only) till 23rd April, 2018 and furnishes solvent surety for Rs.3,33,00,000/- (Rs. Three Crores Thirty Three Lakhs only) till 17th May, 2018, the interim protection granted by the judgment dated 21st March, 2018 shall continue.

2 cam9.18 ii) If the appellant fails to comply with any of the above conditions, the interim order shall cease to operate from 18th May, 2018 and the respondent Municipal Corporation will be at liberty to take action as per the notice/communications issued by it.

The civil application is disposed in the above terms.
