DATE : AUGUST 16, 2017 By this application it is prayed that the nonapplicants be restrained from creating any third party rights in the suit property.

The suit as filed is for specific performance of agreement. The suit was dismissed by the trial Court and said decree is confirmed by the first Appellate Court. Parties were directed to maintain status quo on 27/04/2017.

As the appeal has now been admitted, it is necessary to protect the suit property. Hence application is allowed in terms of prayer clause (a).

Civil application is disposed of.
