The present application is for grant of bail under Section 439 of the Code of Criminal Procedure in connection with Crime No.538/2021 registered with Police Station Arni, District Yavatmal for the offences punishable under Sections 376(2)(n) and 506 of the Indian Penal Code and Sections 4 and 6 of the Protection of Children From Sexual Offences Act.

After going through the investigating papers and after hearing the learned Counsel for the applicant to some extent, I have shown the disinclination to grant bail. In view of that, learned Counsel for the applicant seeks permission to withdraw the application with liberty to file before the trial Court, after the evidence of the victim is recorded.

The application is disposed of, as withdrawn with liberty to file before the trial Court after recording the evidence of the victim.
