JAIN, JJ DATE : 23.7.2015 The petitioner has approached this court challenging the notice issued by the Recovery Officer since the learned Debt Recovery Appellate Tribunal is not available at Mumbai. The learned counsel appearing for respondents 2 and 4 state that the Presiding officer, who is given a charge of the Debt Recovery Appellate Tribunal, Mumbai, is likely to have sitting on 27 th and 28 th of July at Mumbai.

In that view of the matter, we dispose of the petition relegating the petitioner to alternate remedy available in law. However, the interim order operating from 12 th July, 2015, shall continue for a period of ten days from today.
