The petitioners claim that they have been working as security guards for quite some time. However, a question has arisen as to whether they are eligible to function as such because of deficiency in height criteria. Seeking relaxation of the height criteria, the petitioners have approached the Principal Secretary, Department of Labour Welfare of the State of Maharashtra with a representation dated 3/5/2021. Such representation is reportedly pending. 2.

2607wp2566 of 2021.odt Pleader appearing for the respondent nos.1 and 2 are ad idem that the interests of the petitioners would be sufficiently taken care of if the Principal Secretary is directed to consider and dispose of such representation within such time-frame as may be fixed by this Court.

Having regard to the above, we find no reason to keep this writ petition pending. The same is disposed of with a direction to the Principal Secretary, Department of Labour Welfare of the State of Maharashtra to consider and dispose of the petitioners' representation dated 3/5/2021, in accordance with law and by passing a reasoned order, within a period of four weeks from date of receipt of a copy of this order together with a copy of this writ petition. 4.

It would be desirable if the Principal Secretary while disposing of the representation grants the authorized representative of the petitioners an opportunity of hearing. 5.

There shall be no order as to costs.

All contentions are kept open.
