By this application, the applicants/petitioners are seeking relief of status quo to protect possession over Survey No.45 mouja Menkhat, Tahsil Samudrapur, District Wardha.

The prayer in the petition is to the validity of the order passed by Maharashtra Revenue Tribunal, Nagpur in proceedings arising out of Bombay Tenancy and Agricultural Lands (Vidarbha Region) Act, 1958. The scope of the petition is only to consider the validity of the order of Maharashtra Revenue Tribunal and to ascertain whether the Authorities under the Bombay Tenancy and Agricultural Lands (Vidarbha Region) Act have complied with the provisions of the said Act or not. The relief, which is now sought by the applicants is beyond the purview/scope of the writ petition.

In that view of the matter, this application cannot be entertained. The application is rejected as not maintainable.

The applicants are at liberty to adopt all remedies, which are permissible in law.
