CAW NO. 1020/2017 IN WRIT PETITION NO. 3407 OF 2016 (Shri Sunil Kisan Kengarkar vs. Akola Municipal Corporation thr. its Municipal Commissioner, Akola & Ors.) AND CAW NO. 1019/2017 IN WRIT PETITION NO. 3408 OF 2016 (Shri Rajesh Panjabrao Jawarkar vs. Akola Municipal Corporation thr. its Municipal Commissioner, Akola & Ors.) _____________________________________________________________________________ Office Notes, Office Memoranda of Coram, appearances, Court's orders or directions Court's or Judge's orders.
and Registrar's Orders.
CORAM : B.P. DHARMADHIKARI & MRS. SWAPNA JOSHI, JJ.
NOVEMBER 29, 2017.
Shri P.S. Khubalkar, learned counsel for the applicants/ petitioners, Shri A.K. De, learned counsel for respondent No. 1 and Shri A.S. Fulzele, learned Additional GP for respondent Nos. 2 to 4.
2.
Prima facie, we find that the applicants did not have any right to post and because of leniency shown by this Court or then by the State Government, they continued in employment for long time. Resulting this, they were also shifted to clerical post by their employer.
3.
The employer submits that this shifting was because of influence brought by the applicants on government and directions of the government. However, after the work was over, they were terminated. 4.
Writ Petitions are already admitted for final hearing. Merely long period of service rendered by them cannot be a ground for continuation. Civil Applications are, therefore, rejected. No costs.
