DATE : 15.5.2015 Heard Shri Aakash A. Gupta, the learned advocate for the applicant and Shri S.M. Ukey the learned A.P.P. for the non-applicant. This is an application praying for per-arrest bail in the crime registered by the non-applicant for the offence punishable under Section 376(2)(n) and Section 506 of the Indian Penal Code. The complainant aged about 45 years has filed the complaint against the applicant alleging that he is indulged in the offence in respect of which the matter is registered by the non-applicant. Shri Gupta, the learned advocate for the petitioner has submitted that the applicant is implicated in the matter. He has further submitted that the applicant is a law abiding citizen and has not been prosecuted for any offence any time earlier.
Considering the facts of the case, the following order is passed :-
2 aba230.15 In the event of arrest of the applicant in Crime No.213/2015, registered by Gittikhadan Police Station, the applicant shall be released on bail on furnishing P.R. bond in the sum of Rs.20,000/ (Rs. Twenty Thousand Only). In addition, the applicant shall furnish solvent surety of a person who is resident of Nagpur, for Rs.20,000/- (Rs. Twenty Thousand Only).
The applicant shall not leave Nagpur without informing the concerned police station.
The applicant shall report at the concerned police station once in a week.
Application is allowed accordingly.
