DATED : AUGUST 25, 2020 Hearing was conducted through video conferencing and the learned counsel agreed that the audio and visual quality was proper.
Heard Mr. Ambatkar, learned counsel for applicant and Mr. Palshikar, learned A.P.P. for non applicantState. Also perused the detailed reply. The applicant is arrested in connection with Crime No. 680/2020, registered with Police Station Ram Nagar, Chandrapur for an offence punishable under Sections 188, 272, 273, 420, 468, 472 of the Indian Penal Code and Section 59 of the Food Safety and Standards Act, 2006. According to prosecution case, present applicant along with his two colleagues brought scented tobacco of Maza, Eagle and Hukka company. They have mixed the same, filled it in the boxes of Maza scented tobacco and adulterated it for selling illegally in the market. Even according to the reply, after raid, the entire scented tobacco, other equipment and vehicles were seized. The applicant is owner of the farm house.
LDVCBA1060.20.odt Since, the entire contraband is already seized and there is nothing in the reply that the applicant is having any past criminal record, I pass the following order.
ORDER
(i) The application is allowed.
(ii) Applicant-Shashim s/o Premanand Kamble be released on bail in connection with Crime No. 680/2020, registered with Police Station Ram Nagar, Chandrapur for an offence punishable under Sections 188, 272, 273, 420, 468, 472 of the Indian Penal Code and Section 59 of the Food Safety and Standards Act, 2006, on he executing P.R. Bond in the sum of Rs.25,000/- with one solvent surety in the like amount.
(iii) The applicant shall attend Police Station, Ram Nagar, Chandrapur, once in a month i.e. on last Sunday of every month till filing of the charge-sheet.
The application is disposed of.
