DATED : 11-08-2021 The applicant is seeking bail on the ground of delay in completion of trial and, in the alternate, a temporary bail on medical ground.

Both grounds are absolutely unmerited.

The offence alleged is heinous. The applicant and co-accused allegedly brutally murdered 4 members of one family.

The learned Additional Public Prosecutor Mrs. Deshpande states that the trial has already commenced and as many as six witnesses are already

2 ba 697.2021 examined. In this view of the matter, there is no delay in completion of the trial.

It is submitted that the applicant is advised a Cataract operation. Cataract operation cannot be a ground for releasing the applicant even on temporary bail considering the grave accusations of killing 4 members of a single family. Moreover, if any medical treatment is needed, there is no reason to assume that the jail authority will not do the needful.

The application is dismissed.
