At the outset, it may be mentioned here that on 18.8.2020 this Court was required to pass order since Office of the Public Prosecutor was not getting instructions from Jaripatka Police Station, Nagpur.

Today, learned Additional Public Prosecutor Shri Vinod Thakare for the State, appeared and upon instructions from Jaripatka Police Station, Office of the Public Prosecutor prepared reply and the said is filed on record. In the said reply, explanation is offered by officers of the said Police Station that 7 police officers of the same police station were tested Covid-2019 Positive. Resulting into certain difficulties due to which in time instructions were not given to the Office of the Public Prosecutor. I accept the explanation.

Heard learned counsel Shri M.N.Ali for the .....2/-

aba817.20 5 applicant and learned Additional Public Prosecutor Shri Vinod Thakare for the State, in extenso.

This is an application for grant of anticipatory bail since the applicant is apprehending his arrest in connection with Crime No.1311/2019 registered with Jaripatka Police Station, Nagpur for offences punishable under Sections 20 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

After a detailed hearing of learned counsel Shri M.N.Ali for the applicant and learned Additional Public Prosecutor Shri Vinod Thakare for the state and when the Court expressed its opinion that the Court is rejecting the application for grant of anticipatory bail, learned counsel for the applicant submitted that he has instructions from the applicant to withdraw the application.

Consequently, the application of the applicant for grant of anticipatory bail for the aforesaid crime is hereby rejected as withdrawn.
