DATE : 04.02.2015 Though I find that the explanation given in the application for condonation of delay is not satisfactory, considering the facts of the case and the undertaking given by the applicant that the applicant will not claim interest on the amount that may be enhanced by the Court in first appeal for the period from 17.8.2005 till today, the delay in filing the appeal is condoned. The civil application is allowed in the above terms. FIRST APPEAL ST. NO.9481/2013 Taken up on board for admission.

The appellant shall file private paper-book within six months, failing which the appeal shall stand dismissed without reference to this Court.
