Heard the learned Advocate for the appellant/defendant. 02] Though the suit was dismissed, the first appellate Court partly decreed the suit and defendant No.1-Pundlik Dhokane was restrained from running the flour mill without licence. This judgment was stayed during pendency of the second appeal. It is submitted that due to old age, the appellant has stopped running flour mill and he do not want to continue with the appeal.

03] The appeal is disposed of as not pressed. The parties to bear their own costs.
