Heard Shri R.D. Karode, learned counsel for the applicants. The present application is filed for quashing of First Information Report lodged with Police Station Old City, Akola vide Crime No. 748/2021 for the offences punishable under Sections 463, 467, 471, 420 read with Section 34 of the Indian Penal Code.

According to the learned counsel for the applicants, the applicants are Talathi and Circle Officer. This is their submission that they have not committed any wrong, they only obey the orders, those were given to them by the Tahsildar. Therefore, they are not responsible for any forgery, as alleged by the prosecution in the Government record. We are afraid to accept this particular submission.

The matter is serious inasmuch as the Government record is forged. The submission made before us by the learned counsel for the applicants is in the nature of their defence that will be tested during the course of trial. There is no merit in the application.
