Hearing was conducted through Video Conferencing and the learned counsel agreed that the audio and visual quality was proper.

The applicants are apprehending to be arrested in connection with F.C.R. No. 608/2014 relating to the offence punishable under Sections 42(1), 42(2), 52(2), 55 and 61(1) of the Indian Forest Act, 1927. It is alleged that the forest property i.e. cut woods were seized along with vehicle at the time of occurrence. The statement of co-accused discloses that the involvement of
applicants who were allegedly present. It is a case that co-accused stated that applicant No. 2 Shaikh called them to purchase the forest property.

Similar type of offence was registered one month prior to the occurrence. In the said crime also forest property and vehicle were seized. Pre-arrest protection was provided to the applicant in earlier crime .

It reveals that woods were cut and it were loaded in tractor trolley. The forest officers have seized entire material. At this juncture, besides statement of co-accused, there is nothing to indicate active involvement of applicants in the crime. The alleged offence would attract maximum punishment upto one year of imprisonment. Having regard to the nature of offence, type of accusation and other circumstances, interim protection can be continued on certain terms and conditions.

In view of that order dated 24.07.2020 is made absolute with further direction to attend concerned Investigating Officer on every Sunday from 10.00 a.m. to 12.00 noon till filing of chargesheet. 6.
Application stands disposed of.
