Heard Mr. Gour, learned counsel for the applicant, Mr. Laddhad, learned A.P.P. for non applicant no.1 and Mr. Trivedi, learned counsel for non applicant no.2.

The present application is for condonation of delay in filing the appeal before this Court. The applicant is original complainant. Her complaint is dismissed. The delay caused is of 58 days.

I have gone through the contents of the application and after hearing learned counsel for both the sides, I am of the view that in the interest of justice, the delay should be condoned. However, the applicant should pay costs of Rs.1,000/- to the non applicant no.2. Mr. Trivedi, learned counsel for non applicant no.2 has instructions to receive the amount of costs.

295/2015 is allowed. The delay caused in filing the appeal is hereby condoned.

The amount of costs should be paid to Mr.Trivedi, learned counsel for non applicant no.2 within a period of one week from today.
