IN THE HIGH COURT OF JUDICATURE AT BOMBAY,

NAGPUR BENCH, AT NAGPUR.

J. Lonare, Advocate for the petitioners Mr. S. J. Kadu, Advocate for respondent 2 Mr. N. R. Rode, AGP for respondent 3 CORAM : ROHIT B. DEO, J.

DATED : 12- 4The challenge in the petition is to the refusal by the Agricultural Produce Market Committee to grant Adatiya license.

2.

The refusal is appealable under Section 9(a) of the Maharashtra Agricultural Produce Marketing (Development and Regulation) Act, 1963.

3.

While the relief claimed in the petition is also opposed on the ground that there is unexplained delay in as much as the order of refusal of license is passed on 15-10-2015 and the petition is filed on 24-4-2018, I am not inclined to delve deeper since all issues can be addressed by the appellate authority, if the petitioners opt to avail appellate remedy.

4.

With liberty to the petitioners to take recourse to such remedy as is available, the petition is dismissed. JUDGE YUVRAJ WASNIK wasnik
