Offence punishable under Section 379 read with Section 34 of IPC are registered against the applicants. Offence is triable by Judicial Magistrate First Class.

Learned Advocate for the applicants has submitted that the applicants were in PCR and vehicle was seized from the applicants.

Shri Ashirgade, learned Additional Public Prosecutor for the State/non-applicant has strongly objected the present application and submitted that the applicants were caught when they were attempting to commit theft.

Looking to the allegations against the applicants, Criminal Application is allowed.

The applicants be released on bail on their executing P.R. Bond in the sum of Rs.25,000/- each with one solvent surety each of like amount on the following conditions. (a) The applicants shall not tamper with the evidence of prosecution witnesses.

(b) The applicants shall attend the trial Court on each and every date.
