This is an application for condonation of delay in filing criminal revision application challenging order passed below Exhibit-7 dated 11.8.2016 in Petition No.E-413 of 2015 passed by learned Judge of the Family Court No.3 at Nagpur. 2.

For preferring the revision, there is a delay of 156 days. Therefore, the application is filed. On 19.9.2017, the Notice was issued. The Notice was served on the non-applicant. 3.

On 10.11.2017, when the matter was listed before the Court, at the request of learned counsel Shri M.A. Gadge for the non-applicant, the case was adjourned by way of last chance and it was kept on 24.11.2017.

On 24.11.2017, the matter was again adjourned and kept for today.

Today, in the morning session, when the matter .....2/-

appr68.17 20 was called out, nobody was appearing on behalf of the nonapplicant. Learned counsel Shri M.A. Gadge was also absent. Therefore, in order to give a chance to the non-applicant, the matter was kept in the second half.

In the second half, when the matter is called out, nobody is putting appearance on behalf of the non-applicant and learned counsel Shri M.A. Gadge is also absent. 7.

The application is affirmed by Shri Sheikh Abrar s/o Sheikh Sattar. No reply is filed thereby statements on oath are remained uncontroverted.

In that view of the matter, the criminal application for condonation of delay is allowed. Delay of 156 is hereby condoned subject to payment of costs of Rs.500/- to the High Court Bar Association at Nagpur to be paid within a period of one week from today.

The applicant to produce on record the copy of the receipt showing the payment of costs.

The application is allowed and disposed of.

Office is directed to register the revision.
