The applicant is apprehending arrest in Crime 148/2020, registered with Police Station, Ramnagar, Chandrapur, for offence punishable under sections 420, 467, 468, 471 read with section 34 of the Indian Penal Code.

This application was heard at length on 23.11.2020 and was adjourned to enable the learned counsel Mr. A.A. Dhawas to make further submission. 4.

Today, Mr. A.A. Dhawas states that the dispute is amicably settled. A categorical statement is made, on instructions, that the applicant shall surrender and hand over possession of the plot in question to the real owner on or before 15.1.2021. This statement is accepted as an undertaking to the Court.

I am prima facie giving some credence to the submission of the applicant that he is an innocent purchaser

aba399.2020.odt of the plot, only because the undertaking which is referred to supra is given. The applicant would be well advised to note that breach of the undertaking come for whatsoever reason, shall not only entail withdrawal of interim protection, this Court may consider initiation of action under the Contempt of Court Act.

Let a copy of this order be forwarded to the Investigating Officer, who then shall summon the complainant and hand over a copy to him, within next week.

In view of the undertaking, the interim protection granted vide order dated 28.8.2020 is made absolute.
