Patil, learned counsel for the applicants/appellants tendered Pursis and submitted that the respondent - decree holder in execution proceeding obtained the possession of the suit property from the applicants thereby the applicants are not in possession of the suit property and therefore, the applicants do not want to proceed further in the present matter and instructed the Counsel to withdraw the Second Appeal. The Pursis is taken on record.

In view of above, the Civil Application No.1081 of 2022, seeking condonation of delay of 290 days to file second appeal, in Second Appeal (St.) No. 8468/2022, is disposed of as withdrawn.
