This Court, having noticed the absence of respondents no.2 and 3 issued non-bailable warrant by order dated 17th April 2017. 2.

The application is moved for cancellation of non-bailable warrant on the ground that on 17th April 2017 appearing for respondents no.2 and 3 was in this Court.

The explanation tendered in the application is accepted pursuant to the assurance given by learned Counsel for respondents no.2 and 3 that they shall continue to appear before this Court on each and every date of hearing of the matter.

As such, the order of issuance of non-bailable warrant is recalled subject to payment of costs of Rs.1,000/- each to be paid to High Court Bar Association's library, Nagpur.
