Present application is for condonation of delay of 245 days, which is caused in filing the appeal.

Issue notice to the respondents, returnable in four weeks. Ms Udeshi, learned Assistant Government Pleader waives notice for respondent Nos.2 and 3.

CIVIL APPLICATION (F) NO.1106 OF 2023 4.

By this application, the appellant is seeking stay to the effect and operation of the impugned judgment and decree dated 04.04.2019 passed by the Civil Judge Senior Division, Darwha in L.A.C. No.33 of 2008.

Mr Dhumane, learned Advocate for appellant submitted that the principal amount is already deposited. 6.

On depositing the balance interest amount alongwith statutory amount within ten weeks from today, the effect and operation of the impugned judgment dated 04.04.2019 in L.A.C. TAMBE

38 CAF-1105-2023 No.33 of 2008 be stayed, till final disposal of the appeal. 7.

On failure to deposit the balance interest amount alongwith statutory amount within above said period, the stay granted will be vacated automatically without further reference to the Court.

The civil application is disposed of.
