The husband of the petitioner was working as Hostel Superintendent at a residential Ashram School. He was so appointed on 10/08/2000 and he expired in harness on 25/12/2019. The petitioner-his widow claims benefit of the Assured Career Progression Scheme (ACPS) in terms of Government Resolution dated 30/04/1998. Representation seeking such benefit has been made to the respondent No.3 on 21/02/2022.

Considering the fact that this Court has decided similar Writ Petition No.178/2014 (Vilas Laxman Dukale and ors. vs. The State of Maharashtra Thr. Secretary, Social Welfare Dept. Mantralaya, Mumbai and ors. with connected writ petition) claiming benefit of the aforesaid Scheme as per Government Resolution dated 30/04/1998 on 22/07/2014, the writ petition is disposed of by directing the respondent No.3 to examine the case of the petitioner for deciding whether her husband satisfies the criteria laid down for claiming benefit under the ACP scheme to private aided Government schools under the Government Resolution dated 30/04/1998 as modified from time to time and if it is found that the husband of the petitioner was entitled to claim benefit under that scheme and he satisfied the eligibility criteria, the respondents shall scrutinize his case within a period of six months and extend such benefit to him as expeditiously as possible and preferably within a period of four months from such scrutiny.

Rule is made absolute in aforesaid terms with no order as to costs.
