By this application, it is prayed that the delay in filing the second appeal be condoned.

In the application, it is stated that the applicants had handed over all necessary documents to the counsel for filing the second appeal. Said counsel lost sight of the case and the papers remained with him.

Today, affidavit of the learned counsel has been placed on record.

The learned counsel for the non-applicant opposes the prayer on the ground that no sufficient cause has been made out. He has relied upon the reply filed on record. After hearing the learned counsel and after perusing the affidavit dated 11.07.2018 filed on behalf of the applicants, I find that the delay does not appear to have been deliberately caused. Hence, by accepting the reasons as mentioned, the delay in filing the second appeal stands condoned. Civil application is disposed of.
