This application is filed by Shri P.V. Navlani, learned counsel for the non-applicant No.2 for discharge of his power. During the course of hearing, he submits that inadvertently Annexure-I of the application is not placed on record. He tenders the same in the Court which is taken on record. Annexure-I is a registered notice dated 20.01.2021 addressed to non-applicant No.2 - Ashok Mahadeorao Tembhre, whereby it was informed by Shri P.V. Navlani, that if the instructions are not given to him, he will seek discharge from the Court. The photocopy of acknowledgment showing the receipt of the letter dated 20.01.2021, is also placed on record.

In that view of the matter, the criminal application is allowed.
