DATE : 23rd MARCH 2022 By this application, the applicant (wife) is seeking transfer of divorce petition filed by the non-applicant (husband) from the Family Court at Akola to Family Court at Nashik. 2.

It is contended that the applicant has also initiated proceedings in the competent Court at Nashik under the Protection of Women from Domestic Violence Act, 2005 and Hindu Adoptions and Maintenance Act, 1956.

Although the non-applicant has filed a reply opposing the present application, Mr. Dhumane, learned counsel appearing for the non-applicant, on instructions, states that if a direction is given for expeditious disposal of the petition filed by the non-applicant upon transfer, he would not oppose the present application. 4.

In view of the above, the application is allowed. Divorce Petition filed by the non-applicant bearing Petition No. A-60/2020, pending before the Family Court at Akola is transferred to the Family Court at Nashik. The Family Court at Akola is directed to immediately transmit the record to Family Court, Nashik.

The Family Court at Nashik is directed to dispose of the aforesaid petition for divorce filed by the non-applicant within nine months of receipt of the record from the Family Court at Akola.
