The challenge in the present writ petition is to an interlocutory order passed below Exhibit 25 whereby respondent no.4 in the proceedings before the learned District Judge had sought an order as regards abatement of the proceedings on the ground that the newly elected executive committee was not impleaded as a party.

After hearing learned counsel for the petitioner for some time, it is seen that the learned District Judge has observed that the applicant before it had already completed its arguments. In the light of the fact that the present application was filed on 09.03.2017 after which the matter has reached this Court on two occasions, I find that the challenge to the impugned order can be kept open for being raised after the final orders are passed in M.J.C. No.162 of 2016.

In that view of the matter, the writ petition is not entertained at this stage. The points raised are kept open for being agitated at the behest of the petitioner if the need arises. JUDGE APTE
