A disputed question arise, hence without prejudice to his contentions raised in the matter, learned counsel for petitioner seeks leave to withdraw the criminal application with liberty to raise it by filing appropriate application before the trial Court. 3.

In this situation, without observing anything on the merits of the controversy, we dispose of the criminal application as withdrawn with liberty to applicant to take such other steps as are open in law. No costs.
