DATED : 27 th SEPTEMBER, 2019 Learned Additional Public Prosecutor objected to the tenability of the petition on the ground that appeal under Section 60 of the Maharashtra Police Act is provided against impugned order and now the appellate powers are delegated to the Divisional Commissioner.

In view of the above objection, learned Advocate for the petitioner seeks permission to withdraw the petition with liberty to avail alternate remedy.

The writ petition is disposed as withdrawn with liberty as prayed for.
