Heard the respective counsel for the parties. The appellants herein were convicted by the learned Additional Sessions Judge, Gondia vide judgment and order dated April 11, 2016, for an offence punishable under the provisions of the Indian Penal Code and the Scheduled Castes & Scheduled Tribes ( Prevention of Atrocities) Act, 1989. The maximum sentence awarded is three years. It is the case of the appellants that they were on bail during the trial and of the offence under which they are punished, some of them are bailable. It is then brought to my notice that the bail granted earlier was not jumped. In view thereof, in my opinion, case for suspension of sentence and grant of bail is made out. The application stands allowed. The appellants be released on bail on the terms and conditions on which they were released on bail by the learned trial court.
