However, I am not passing an order of dismissal, since the learned counsel for the applicant Mr. Mir Nagman Ali seeks leave to withdraw the application with liberty to approach this Court afresh, if there is no effective hearing in the trial in the next six months. 3.

The application is dismissed as withdrawn.

If there is no effective hearing in the next six months, the applicant shall be entitled to approach this Court afresh, provided :
