------------------------------------------------------------------------------------------------------------------------------------- Shri Ashwin Deshpande, Advocate for Petitioner. Shri K.L. Dharmadhikari, AGP for Respondent Nos.1 & 2. CORAM: RAVINDRA V. GHUGE AND S.M. MODAK , JJ.
DATE: 11 th FEBRUARY, 2020.
1] We have heard the learned Advocate for the petitioner and the learned AGP on behalf of the respondents. We have perused the earlier orders. 2] We find that the Committee needs to make a statement as regards the time frame within which it would decide the tribe claim of the petitioner.
3] The learned AGP submits that the Committee would decide the tribe claim of the petitioner within six months.
4] Since we find that the petitioner had earlier approached the Committee at Chandrapur, erroneously and his claim was then transmitted to the appropriate Committee at Amravati and this has consumed about 12 years, that this petition is disposed off with a direction to respondent No.2 to decide the tribe claim of the petitioner
wp2685.17.O.odt as expeditiously as possible and in any case on or before 31.08.2020.
5] The petitioner shall appear before the Competent Committee on 28.02.2020 at 03:00 p.m. and shall abide by the dates on which the Committee would post the matter. The Committee shall be duty bound to decide the claim on or before 31.08.2020 and in the event it notices that the petitioner is seeking adjournments on unreasonable grounds, it would be at liberty to reject such application and proceed with the matter.
