By present application, petitioner is seeking directions against the respondents to investigate the matter through Agency like CBI or Directorate of Enforcement by lodging FIR.

Thus, the FIR itself has not been lodged. If that be so, petitioner may avail alternate and efficacious remedy under Section 156(3) of the Code of Criminal Procedure (Under Section 175 of the BNSS, 2023).

Learned counsel for petitioner seeks time to take instructions.

Time granted.

Counsel for petitioner seeks time on the ground that the arguing counsel is before another Court.

We do not feel it necessary to pass over the matter inasmuch as when there is an alternate and efficacious remedy available, which the petitioner can avail.

With above liberty, the writ petition is disposed of. Criminal Application (APPW) No.130/2021 In view of disposal of the writ petition, the application also stands disposed of.
