17th May, 2016 The present application has been filed under Section 439 of the Criminal Procedure Code.

The Applicant has been arrested on 7th April, 2016 in Crime No. 158/16 registered under the provisions of Section 65 (e) of the Maharashtra Prohibition Act.

Reply has been filed on behalf of the Nonapplicant, in which it is stated that about eleven cases were pending against the present Applicant, all under the provisions of the Maharashtra Prohibition Act. It is submitted by the learned counsel for the Applicant that in six cases, the Applicant has been acquitted, while two cases are fixed for passing orders.

Heard.

Considering the nature of offence and the fact that the incriminating material has already been seized by the prosecution, the further custody of the applicant is not found necessary.

Hence, the Application is allowed.

[a] The Applicant is directed to be released on bail in Crime No. 158/16 registered with Police Station, Rajura, Distt. Chandrapur, for offence under Section 65 (e) of the Maharashtra Prohibition Act, on furnishing a Personal Bond of Rs. 20,000/- [rupees twenty thousand only] with two solvent sureties in the like amount.

[b] The applicant shall attend Rajura Police Station as and when directed by the Investigating Officer.

[c] No steps shall be taken to interfere in the investigation.
