DATE : February 15, 2019 In the light of pursis dated 06/02/2019 in which it has been stated that the present appeal can be decided in view of the adjudication of F. A. 486/2011, this appeal is taken up for hearing.

The challenge in this appeal is to the adjudication by the Reference Court in L.A.C. No.259/1999 which relates to acquisition of land from village Sawardi. In F.A.No.486/2011 by judgment dated 30/08/2016 this Court has observed that an amount of Rs.1,00,000/- per hectare for land acquired from village Sawardi would be just compensation. In the present proceedings the Reference Court has granted compensation at the rate of Rs.1,00,000/- per hectare.

Hence, by adopting the reasons in First Appeal No.486/2011 the judgment of the Reference Court in L.A.C. No.259/1999 stands confirmed.

The claimants are at liberty to withdraw the amount of compensation along with accrued interest from the Reference Court.
